PRIVACY POLICY

 

Protecting your privacy is a priority of ABARTA Coca-Cola Beverages, Inc. (“ACCB” or “we”, “us” or “our”).  This Privacy Policy (“Policy”) applies to your access and use of the ACCB e-commerce portal (the “Portal”) whether such access is on behalf of yourself, your company or your employer, (collectively, “You”, “you” or “your”) or any other entity on whose behalf you are acting in purchasing goods or services from ACCB or its affiliates (a “Represented Purchaser”) and governs how ACCB collects, uses, stores and protects your information.

 

By using the Portal, you consent to the data practices described in this Policy. You understand that we may update this Policy from time to time and it is your responsibility to review the Policy for any changes. Your use of the Portal after we post an updated Policy constitutes your acceptance of the Policy as modified.

 

By accessing and using the Portal and providing us with your data, you acknowledge and agree that your or your Represented Purchaser’s personal information may be processed for the purposes outlined in this Policy. If you submit any personal information that is not your own, you represent and warrant that you have the authority to do so and permit us to use that information in accordance with the terms outlined below. 

   

COLLECTION OF YOUR INFORMATION

ACCB may collect, store, and use the information you provide to ACCB through the Portal. This information can include, but is not limited to personally identifiable information (which includes[JF1]  but is not limited to your name, address, birthdate and occupation) billing, banking and credit card information. This information will be used in completing your purchase transactions. By using the Portal, you also understand and consent (on behalf of yourself and any Represented Purchaser) to ACCB collecting and storing additional personal and/or non-personal information.

 

Information about your computer hardware and software may be automatically collected by ACCB. This information may include but is not limited to: your IP address, HTTP header, system date, full request, status, content length, method, URI, URI Query String, protocol, browser type, domain names, access times, location at the time of access and referring website addresses. This information may be used for several reasons, including but not limited to (i) the operation of the Portal; (ii) to maintain quality of the Portal; or (iii) to provide general statistics regarding use of the Portal.

 

We encourage you to review the privacy statements of websites you choose to link to from the Portal so that you can understand how those websites collect, use and share your information. ACCB is not responsible for the privacy statements or other content on websites outside of the Portal.

 

USE OF YOUR PERSONAL INFORMATION

ACCB collects and uses your personal information, or the information of your Represented Purchaser, to operate its Portal and deliver the services you have requested. Your information, or the information of your Represented Purchaser, may be collected and stored for a number of reasons:

·         to improve the Portal’s functionality and services and streamline your experience;

·         to send administrative information to you such as changes to the Portal, terms of use and this Policy (because these communications are important to your use of the Portal, you may not opt-out of receiving these communications);

·         to complete and fulfill your purchase and delivery of the goods you have ordered on the Portal, communicate with you regarding your purchase and provide you with customer service;

·         to provide you with updates, order reminders, promotions, announcements regarding our products and special programs that you may be invited to participate;

·         to respond to your inquiries, address any customer concerns and fulfil your requests; and

·         for internal business analysis and other business related purposes.

 

By using the Portal, you understand that we may also use your information, or the information of your Represented Purchaser, to inform you of other products or services available from ACCB and its affiliates and to keep you informed about updates to this and other policies. ACCB may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

 

THIRD PARTY DISCLOSURES

ACCB does not sell, rent or lease its customer lists to third parties. However, ACCB may occasionally, in its sole discretion, provide your email address to third parties for the distribution of ACCB marketing and promotional information. ACCB may also share your data with third parties to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to ACCB, and they are required to maintain the confidentiality of your information; provided that ACCB shall not be liable for any prohibited use or disclosure by any such third parties of your information or the information of your Represented Purchasers.

 

ACCB will disclose your personal information, without notice, where permitted or required to do so by law or in the good faith belief that such action is necessary to: (a) obey court orders or comply with legal process served on ACCB or the Portal; (b) protect and defend the rights or property of ACCB; and, (c) act under exigent circumstances to protect the personal safety of users of the Portal, or the public.

 

USE OF COOKIES

The ACCB website may use "cookies" to collect data and help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

 

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize your ACCB Portal, or register with ACCB for services, a cookie helps ACCB to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same ACCB website, the information you previously provided can be retrieved, so you can easily use the ACCB features that you customized.

 

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Portal or websites you visit.

 

SECURITY OF YOUR PERSONAL INFORMATION

ACCB will not collect or store your data on its servers. Rather, your data will be collected and stored on a secure third party platform and servers. Access to this data is not controlled by ACCB. ACCB does not store nor does it have the ability to view any customer’s information except for those who have registered on the ACCB Portal. Customer’s credit card information will not be stored on the ACCB Portal.  Other than in the case of its gross negligence, ACCB shall have no liability to you or any of your Represented Purchasers if personal information is disclosed or accidentally released from such third party platform or the servers related thereto.

 

THIRD PARTY WEBSITES & APPLICATIONS

The Portal may contain links to third-party websites or applications. When you click on a link to any other website or application you will leave the Portal and go to that website where that entity may collect your personal information. You understand that we do not have control over, do not review and cannot be responsible for, these outside websites, applications, content or any further collection of your personal information after you leave the Portal. We encourage you to review the privacy policies of every website you visit and application you use. Links to third party websites or applications are included on the Portal for your convenience only and do not constitute our endorsement of such third parties or their products, services or content.  

USE BY MINORS

ACCB does not intend for the Portal to be used by individuals under the age of eighteen (18). We also do not knowingly collect personally identifiable information from children under the age of thirteen (13). If we become aware that we have unknowingly collected information from a minor, we will make all commercially reasonable efforts to delete such information.  

 

OPT-OUT & UNSUBSCRIBE

We respect your privacy and give you an opportunity to opt-out of receiving announcements and certain communications. Users may opt-out of such communications from ACCB by contacting us here: abartamycokesupport@coca-cola.com or 1-844-690-2653.

 

CHANGES TO THIS POLICY

ACCB has the right in its sole discretion to occasionally update this Policy to reflect company and customer feedback. ACCB encourages you to periodically review this Policy to be informed of how ACCB is protecting your information. To ensure that your information is protected and that our privacy policies are up-to-date, we may have an independent audit conducted by a third party every time we make major changes to this Policy.
